What is Escrow?

Escrow is a process used in real estate transactions to ensure that both the buyer and the seller fulfill their obligations before the sale is completed.

How Escrow Works in Hawaii 

In Hawaii, the escrow process typically works as follows:

 

  • Opening of the escrow: An escrow account is opened by an escrow agent, who is typically a neutral third party such as a title company, bank, or attorney.

  • Deposit of funds: The buyer deposits funds into the escrow account, which are held by the escrow agent until the sale is complete.

  • Transfer of documents: The escrow agent receives and holds all the necessary documents for the sale, including the purchase agreement, title report, and any other relevant documents.

  • Review and processing of documents: The escrow agent reviews the documents and makes sure that all the necessary conditions of the sale have been met, such as inspections and loan approval.

  • Closing of the escrow: Once all the conditions have been met, the escrow agent releases the funds to the seller and transfers ownership of the property to the buyer.

  • Release of escrow: Once the sale is complete, the escrow account is closed and the escrow agent releases the funds and documents to the appropriate parties.​
